tl;dr:  School administrator asked to investigate rumors that students were passing around nude pictures of each other (taken, mind you, by their own damn selves).  Administrator does his job.  Finds a picture, reports it to his principal.  Parent of the student in possession of the picture is not told about it, finds out anyway, throws a hissy fit and goes to the police.  Overzealous prosecutors try and charge administrator with possession of Child Pornography.

Yeah.  The good news is that the judge here wasn't a total dumbfuck and threw the case out.  The bad news is that this isn't the first such case, just the first such one lobbied at an administrator.

In this one, the girls who took pictures of themselves are being prosecuted as child pornographers.

It's been happening a lot, recently, that students (all of whom are age<18) who had been sent the pictures, the girls who took the pictures, and in one case ( though I cannot find the news story for the life of me) someone who had been sent the picture and even deleted it are being tried as child pornographers and face the very real possibility of being labeled as sex offenders.

This is fucking ludicrous, and highlights a huge weakness in our legal system:  seeking to keep their jobs via election, the prosecutors try and assure the public that they are hard on crime and pursue these retarded cases at the expense of ruining the lives of some children.  Further, the label of Child Pornographer is quickly becoming an overused tool:  I recognize the need to protect young children from exploitation, but the fact that it is being used against teenagers experimenting with people their own fucking age (hur hur hur) says the system needs re-evaluation.

So stupid.  So fucking stupid.

It's completely unforgivable.  What those prosecutors are doing is completely unconscionable.  Child pornography carries harsh sentences (and rightly so) specifically because it promotes actual child abuse.  Anyone found guilty of it would be ruined for life.  To prosecute for child pornography when it's apparent there was no abuse, because the girls took their own photos, is a miscarriage of justice at best, and completely sick.

I can't believe I'm explaining this.  It's a fine argument because, as is well documented, Google picks up everything that is written on a subject (like you, say) despite the newsworthiness or accuracy of the source (see: Strago re Grefter).  Newspapers tend to see themselves as filters that provide news that is not only timely but also accurate.  Y'know, 3 reliable sources and all that.

It's kinda like this.  Michelle Bachmann wants to introduce an amendment forbidding the president from replacing the dollar with an internationally created currency.  Google will tell you so.  Go look it up.  What Google won't tell you is whether or not Obama plans to move away from the dollar (he doesn't).  Unless, of course, you Google a newspaper article about it (Washington Times editorials don't count).

I don't doubt the usefulness of honest to gods news articles.  However I wouldn't discount the value of Google as a part of the news service.

This exists after all.  It IS a good way to get info about shit and it IS relying on Google for your news and it does give a far broader range than buying just the Times does (for example), because as we all know certain papers are more noted for certain stances (Which don't get me wrong, is the good thing for them and about them!  The worst thing the Economist ever does is step outside of economics because gods knows it is having a hard time doing a good fucking job of that!  And Vanity Fair isn't any good when it is being something other than vain).  This doesn't translate to "You shouldn't trust Google" or "You should save the NY Times specifically because it is completely surrounded by wank", it just means that papers need to outlive the actual PHYSICAL print medium and continue to do a good job of covering big topics in their focused areas of expertise (whatever they may be).

Evolve or die, the NY Times isn't anything special in this case.  Deal with the fact that there is far greater meta filters than your chief editor/Human resources department these days and attract audiences by being good at what you do (ie, write good news).  If you are exceptional as a news source then you just might find people going directly to you frequently, but you are far less likely to be the sole source any more and you shouldn't try to be anymore.

Edit - And where was Strago in this?  Did he have a vanishing reply?  If so you make me sad you foul actor.  You are becoming as bad as that Duck we used to know.

Edit 2 - Oh and I would take the NY Times stance on this whole thing if they could write a fucking webpage that didn't make non-IE browsers crash.  (Edit 3 - Note that the joke started back up here) Fuckers, you do realize coding in the sloppy MS viable but not up to industry standards language is fucking shit right?   Fuck you NY Times and fuck your website and it's stupid fucking title text that crashes shit (Or is it their ads?  I don't fucking care anymore.)  Fuck them and their opinion on the internet.  Dog fuckers, Luddites and arse monglers.

This does present a nasty, tricky issue.  Not that I think there's much doubt in the case at hand, although it seems perverse to me to punish someone for murder in this circumstance (if you shoot someone, and 3 years later they die from an infection probably caused by the bullet, are you tried for murder?  I don't believe so).  It seems likely that if the law does punish people who transmit aids ONLY if they knowingly do so, you're gonna find a lot of people simply unwilling to go get tested, even if they suspect.  People are awful like that.

The benefits of a law like this seem pretty obvious, but there are some very major downsides.  Are people who get HIV going to be able to subpoena the medical records of their exes?  Are we going to be allowing victims to finger the people who infect them, then use that as evidence after they die?  If you do tell them you have AIDS, are you culpable for anything?  Will their family be able to press charges for assisting in their suicide if they later die from it?  That's the rational extension of all this.

If you go to work with a nasty cough, what happens if your coworker gets bronchitis?

Miki, I can kind of see your point, but there's no slippery slope argument here.  The issue here is with people who have a highly infectious, untreatable, and terminal disease, and then engaging in mutually consensual behaviour that their partner would not consent to if they knew the risks they'd be taking if they did.

This is especially important due to the fact that when this law was implemented, there was a case in Calgary about a man who had contracted HIV, and then deciding that if he was going to die, he wasn't going to die alone, and went about purposefully trying to spread the disease.  This law is partially there simply to give the government the ability to easily lock such folks up so that they can't continue with such behaviour.

Alex, just curious, but which particular part of that article did you think was worthy of IotD?

Tricky issue.

The Calgary man... well, it seems like there's some actual (confessed) intent there, so charging that person makes sense. But what if the intent isn't there; is it a case of negligence then? If so, do you extend the same thing to going to a retirement home while you have the flu, and infecting somewhere there causing them to die?

You can also argue pretty reasonably that when you have unprotected sex with someone, you're pretty much agreeing to share any diseases they have; I dunno how much specific liability an infected person should carry here. Only punishing those who know their condition encourages people to not get tested which is very bad. Punishing those who don't know is stupid - law requires that you form an intent for any crime you commit, and it can't really be seen as negligent to not get tested for HIV every few months. So basically you can probably only punish those who have a provable intent to harm another, is the conclusion I am arriving at. Which happen to include the cases that get people most up in arms, here... so that works.

Alex, just curious, but which particular part of that article did you think was worthy of IotD?

The part where lobbyists are arguing that the guy should be acquitted/pardoned and trying to turn it into a gay rights issue, mainly.  This is exactly the sort of idiocy that gets that movement set back by decades.

I also disagree rather strongly with some of the views that have come up in this topic, but don't want to derail it into a debate, so... mrf.
