Zero tolerance policy is a giant joke. I think that 3 months of forcing any student, child or adolescent, out of school is really harmful to them and any school who chooses to do this is ridiculous. Yay structure.

More or less my thoughts. Heck, we brought homemade stilettos to school in order to sharpen pencils back then and we never had a case of stabbing either when I was a kid (heck, even when I was a teenager). I guess we do live in different times, but there's a lot of hysteria and absolutely no common sense in this debacle.

Yeah, just to chime in, but when I was in middle school I had a pocket knife that I'd use to sharpen my pencils with because the ones the school had were useless.

I'll mostly echo everyone else about the actual retardation of this. Zero tolerance policies are the worst.

Related note, I didn't even think children that young could be legally head accountable for violent actions.

What? The Rape Tunnel is hilarious and awesome. The only idiocy comes from anyone who actually WENT INTO THE TUNNEL.

Their own god damn fault if they did. It's not like what's actually going to happen isn't advertised.

Sure, the artist is a tool (aren't they all?), but hell he's basically BEGGING to get tazed if anyone with a hint of forethought actually goes into the tunnel. Can't really work up the energy to get mad over that.

I'd say that announcing out loud the intent to wantonly, potentially perenially, harm people at a public event would qualify as something that can get you behind bars, semantics be damned. I'd be shocked if he couldn't get sexual assault attempt charges dropped on his head for that shit. It's like the Beagle Brothers paying a two-minute ad announcing they're going to rob Wall Street at 3PM with tommy guns, only done by someone who somehow couldn't find a better method of getting laid.

Except not at all. For this exhibit, in order for him to actually RAPE anyone, they have to GO THROUGH THE GOD DAMN TUNNEL.

It's more like the whatever brothers announcing that they're going to murder someone, but only if they let them. The act of WALKING THROUGH A LONG TUNNEL THAT GETS SMALLER AS YOU GO IN, while KNOWING DAMN WELL THAT YOU WILL BE SEXUALLY ASSAULTED, requires volition. A will! A desire to go down the tunnel, and get raped. It's not even a semantics argument.

Now, if someone was forced down the tunnel by someone else, the question is more interesting: Who is the rapist, the one who committed the assault or the one who forced the victim down the tunnel?

EDIT: I realize now that I did not make myself clear. I do not think he should be arrested for the announcement, or the exhibit itself. If he actually goes through with it and rapes someone, however, him getting arrested and taken to court is 100% reasonable, and the artist damn well be prepared for a lengthy court battle. The argument of whether or not it is rape is something that should be decided in court anyway.

EDIT 2: On an even more inappropriate note, that court case would be the first in recent memory where the "They was ASKING for it" defense could be taken even remotely seriously.

Well...no, that's not exactly parallel.

It would be like "the robbery tunnel--go into this tunnel, and we will take your wallet." There's clearly consent involved at some point (and particularly with sex, consent is usually the difference between rape and not-rape). Where legality comes into play in the robbery tunnel is that I don't think it's legal to hold on to someone else's credit cards and drivers licences if they request they be returned. Similarly, rape can cause all kinds of stuff that can't be undone, like broken hymens, pregnancy, STDs, psychological damage, physical tearing (note: ctrl-F for Condom on that article produces no results). And, well, people with rape fantasies do exist, so it's not inconceivable that someone would go into that tunnel to fulfill a fantasy, and come out with more than they bargained for. So...frankly yeah, I doubt this is legal, or if it goes forward I doubt it will end with him outside of jail.

If nothing else, it could probably be called prostitution. Presumably he's being paid for his museum display, or gaining attention as an artist, so there's an economic benefit, and he's offering sex.

I don't know what exactly the law is in wherever place the rape tunnel is to be made, but chance is sexual consent can be retracted at any time.

It may depress you to know that there is a real artist, well-respected, who is the clear inspiration here. Pioneer in the performance art field. He had an exhibit once that consisted of him lying underneath the floorboards of a gallery and masturbating while talking about the people there to see his show. That was back in the early '70s, when performance art was in its heyday. I wish I were making this up.
